ÈALA TERMS OF SERVICE
Last Updated: August 2026
OVERVIEW
Welcome to Èala.
Throughout these Terms of Service, the terms “Èala”, “we”, “us” and “our” refer to Èala.
Èala operates this website and online store, including the information, content, features, products, tools and services made available through it (collectively, the “Services”).
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referred to on our website, explain the terms that apply when you access our website or purchase products from us.
Please read these Terms carefully before using our website or placing an order.
By accessing our website, creating an account or purchasing products from Èala, you agree to these Terms.
Nothing in these Terms is intended to limit or exclude any rights you have under applicable Irish or European Union consumer law.
SECTION 1 – USING OUR WEBSITE
You may use our website only for lawful purposes.
When providing information to Èala, including when placing an order or creating an account, you agree to provide information that is accurate, complete and current.
You are responsible for maintaining the confidentiality and security of your account details and password, where applicable.
You must not misuse our website, interfere with its operation, attempt to gain unauthorised access to our systems or use the Services for fraudulent or unlawful purposes.
SECTION 2 – OUR PRODUCTS
Èala offers skincare, cosmetics, beauty products and other products that may be made available through our online store.
We make reasonable efforts to ensure that product photographs, descriptions, ingredients, sizes, colours and other information displayed on our website are accurate.
However, the appearance of products may vary slightly from photographs due to lighting, photography, packaging updates, screen settings or manufacturer changes.
Product packaging, labelling or design may occasionally be updated by the manufacturer without prior notice.
Where ingredients are particularly important to you because of allergies, sensitivities or other concerns, you should check the product packaging and current ingredient list before use.
Product availability is subject to stock.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
SECTION 3 – SKINCARE & BEAUTY INFORMATION
Information provided on the Èala website about skincare products, ingredients, routines or beauty concerns is provided for general informational purposes.
Individual results may vary.
Unless expressly stated otherwise, information provided through our website is not intended to constitute medical advice, diagnosis or treatment.
Customers should follow the manufacturer's instructions and warnings supplied with each product.
If you have concerns regarding whether a particular product or ingredient is suitable for you, you should seek appropriate professional advice where necessary.
Nothing in this section affects your statutory rights concerning products sold by Èala.
SECTION 4 – ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing your order, you may receive an acknowledgement confirming that we have received it.
An order is accepted when Èala confirms acceptance of the order or dispatches the products, as applicable.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
-
A product is unavailable;
-
There is an obvious pricing or product-description error;
-
Payment cannot be authorised;
-
We reasonably suspect fraud or misuse of our website; or
-
We are unable to fulfil the order.
If we cancel an order after payment has been received, we will refund the relevant amount using the appropriate payment method.
Please review your order carefully before submitting it.
If you need to change or cancel an order, contact us as soon as possible at:
We cannot guarantee that an order can be changed or cancelled once processing or dispatch has begun.
SECTION 5 – PRICES & PAYMENT
Prices displayed on the Èala website are shown in the currency indicated on the website.
Where applicable, prices will include VAT or other taxes required by law.
Delivery charges, where applicable, will be displayed before you complete your purchase.
Prices, promotions and discounts may change from time to time.
The price applicable to your purchase will generally be the price displayed when you submit your order, subject to correction of obvious errors and your statutory rights.
You agree to provide accurate and authorised payment information when making a purchase.
Payments may be processed through Shopify Payments or other third-party payment providers available through our website.
SECTION 6 – DISCOUNTS & PROMOTIONS
Èala may occasionally offer discount codes, promotional offers, introductory discounts or other special promotions.
Promotional offers may be subject to separate terms, including expiry dates, minimum purchase requirements or restrictions on particular products.
Unless otherwise stated, promotional codes cannot be exchanged for cash.
We reserve the right to withdraw or amend promotions where reasonably necessary, provided this does not affect orders already validly completed under the promotion or any rights you have under applicable law.
SECTION 7 – SHIPPING & DELIVERY
Orders will be delivered to the delivery address provided during checkout.
Customers are responsible for checking that their delivery information is accurate before submitting an order.
Estimated delivery times may be provided during checkout or elsewhere on our website.
Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.
Delays may occasionally occur because of courier delays, weather conditions, customs issues or circumstances outside our reasonable control.
Nothing in this section limits any statutory rights you may have regarding delivery of goods.
Please refer to our Shipping Policy for further information about delivery charges, estimated delivery times and available destinations.
SECTION 8 – RETURNS & YOUR RIGHT TO CANCEL
Returns are governed by our Refund & Returns Policy and applicable consumer law.
For eligible online purchases, consumers in Ireland and the European Union generally have a legal right to cancel a distance purchase within 14 days of receiving the goods, subject to statutory exceptions.
You must notify Èala within the applicable cancellation period if you wish to exercise this right.
Certain products may be excluded from change-of-mind returns where permitted by law.
In particular, sealed goods that are not suitable for return for health or hygiene reasons may cease to qualify for the statutory cancellation right once they have been unsealed after delivery.
This may apply to certain skincare, cosmetic, beauty and personal-care products.
This restriction does not remove your legal rights where a product is faulty, damaged, incorrectly supplied or otherwise does not conform to your contract.
Full information is available in our Refund & Returns Policy.
SECTION 9 – DAMAGED, FAULTY OR INCORRECT PRODUCTS
Please inspect your order after delivery.
If you receive a product that is damaged, faulty or different from what you ordered, please contact:
Please provide your order number and, where appropriate, photographs showing the problem.
We will assess the issue and provide an appropriate remedy in accordance with applicable consumer law.
Your rights regarding faulty or non-conforming goods are separate from any change-of-mind return policy.
Nothing in these Terms limits your statutory consumer rights.
SECTION 10 – PRODUCT SAFETY
Please read and follow all directions, warnings and instructions provided with skincare and cosmetic products.
Where appropriate, patch testing may be recommended before using a new skincare product.
Stop using a product if you experience an unexpected adverse reaction and seek appropriate professional advice where necessary.
Keep products away from children where indicated by the manufacturer.
Customers are responsible for using products according to the manufacturer's instructions.
Nothing in this section limits Èala's responsibilities or your statutory rights under applicable product-safety and consumer-protection law.
SECTION 11 – INTELLECTUAL PROPERTY
Unless otherwise stated, the Èala website and its original content, branding, graphics, designs, photographs, text, logos and other materials are owned by or licensed to Èala.
Third-party trademarks, product images, brand names and logos remain the property of their respective owners.
You may use our website for your personal, non-commercial use.
You must not reproduce, copy, distribute, sell, modify or commercially exploit Èala-owned content without our prior permission, except where permitted by law.
The Èala name, logo and associated branding may not be used without our permission.
SECTION 12 – THIRD-PARTY SERVICES & LINKS
Our website may contain links to websites, applications or services operated by third parties.
These may include payment providers, delivery companies, social-media platforms and other services.
Èala does not control third-party websites and is not responsible for their independent content, privacy practices or terms.
Please review the relevant third party's terms and privacy policies before using their services.
Nothing in this section excludes responsibility that Èala cannot lawfully exclude.
SECTION 13 – SHOPIFY
Èala's online store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our online store.
However, products purchased through the Èala store are sold directly by Èala.
Your sales contract for products purchased from our store is therefore with Èala and not Shopify.
Shopify may process certain personal information and transaction-related information in connection with providing its services.
Please refer to our Privacy Policy and Shopify's applicable privacy information for further details.
SECTION 14 – PRIVACY
We respect your privacy.
Personal information collected through our website will be handled in accordance with our Privacy Policy and applicable data-protection law, including the General Data Protection Regulation (GDPR) where applicable.
Our Privacy Policy explains:
-
What personal information we collect;
-
Why we collect it;
-
How we use it;
-
Who we may share it with;
-
How long information may be retained;
-
How cookies and similar technologies may be used; and
-
Your data-protection rights.
Please review our Privacy Policy for full details.
SECTION 15 – EMAIL & MARKETING COMMUNICATIONS
Where you have subscribed to marketing communications or where we are otherwise permitted by law to contact you, Èala may send you information about products, promotions, offers and new arrivals.
You may unsubscribe from promotional emails at any time using the unsubscribe link included in our marketing emails.
Unsubscribing from marketing communications will not prevent us from sending necessary transactional communications relating to your orders, payments, deliveries, returns or customer-service enquiries.
SECTION 16 – CUSTOMER REVIEWS & CONTENT
Customers may have the opportunity to submit product reviews, photographs, comments or other content.
By submitting content to Èala, you confirm that you have the right to provide that content and that it does not infringe the rights of another person.
You must not submit content that is unlawful, fraudulent, threatening, defamatory, discriminatory, obscene or otherwise unlawful.
Where legally permitted, you grant Èala permission to display and use content voluntarily submitted for publication in connection with our business and Services.
We reserve the right to moderate or remove content where reasonably necessary.
SECTION 17 – ERRORS & INACCURACIES
We make reasonable efforts to ensure information on our website is accurate.
Occasionally, however, information may contain typographical errors, incorrect prices, inaccurate descriptions or availability errors.
Where an obvious error occurs, we reserve the right to correct the information.
If an error affects an order you have already placed, we will contact you where appropriate and deal with the order in accordance with applicable consumer law.
SECTION 18 – PROHIBITED USES
You must not use the Èala website:
-
For unlawful or fraudulent purposes;
-
To violate applicable laws or regulations;
-
To infringe intellectual-property rights;
-
To harass, threaten or abuse another person;
-
To transmit malicious software or viruses;
-
To attempt unauthorised access to our systems;
-
To collect personal information unlawfully;
-
To send spam or fraudulent communications;
-
To impersonate another person;
-
To interfere with the security or operation of the website; or
-
For any other activity that is unlawful or materially harmful to Èala, our customers or third parties.
We may restrict or suspend access to our website where we reasonably believe these Terms have been seriously violated.
SECTION 19 – AVAILABILITY OF OUR WEBSITE
We aim to keep our website available and operating properly.
However, we cannot guarantee that the website will always be uninterrupted or error-free.
We may temporarily suspend or restrict access for maintenance, security, technical updates or circumstances outside our reasonable control.
Where reasonably possible, we will attempt to minimise disruption.
SECTION 20 – LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms limits or excludes your mandatory rights under Irish or European Union consumer law.
Subject to those rights, Èala will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances outside our reasonable control.
Èala does not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any other liability that cannot legally be limited or excluded.
If you are purchasing as a consumer, these Terms do not affect the legal protections available to you under applicable consumer law.
SECTION 21 – EVENTS OUTSIDE OUR CONTROL
Èala will not be responsible for a failure or delay in performing obligations where that failure or delay results from circumstances outside our reasonable control.
These circumstances may include severe weather, transport disruption, courier disruption, telecommunications failures, industrial action, government restrictions or other events beyond our reasonable control.
Where such circumstances affect your order, we will take reasonable steps to communicate with you and minimise the effect of the delay.
Your statutory rights remain unaffected.
SECTION 22 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
SECTION 23 – WAIVER
If Èala does not immediately enforce a right under these Terms, this does not mean that we have waived that right.
A delay in exercising a right does not prevent us from exercising it later.
SECTION 24 – ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and any other policies expressly incorporated into them, constitute the terms governing your use of the Services and purchases from Èala.
Nothing in this section limits rights or remedies that cannot lawfully be excluded.
SECTION 25 – GOVERNING LAW
These Terms are governed by the laws of Ireland.
If you are a consumer residing in another country, you may also benefit from mandatory consumer protections available under the laws applicable to you that cannot legally be excluded by these Terms.
Any dispute will be dealt with by the courts having jurisdiction under applicable law.
Nothing in this section is intended to restrict any right a consumer has to bring proceedings in a court available to them under applicable consumer law.
SECTION 26 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal and regulatory requirements.
The latest version will be published on our website.
Where appropriate, the “Last Updated” date at the top of these Terms will be changed.
Changes will not retrospectively remove statutory rights relating to purchases already made.
